Terms & Conditions of Sale 1. Definitions "Agreement" is the agreement by which you the "Buyer" agrees to purchase and we the "Seller" agree to sell the Goods. "Seller, we, us" is Natural Stone Solutions Limited (incorporated in England and Wales under company number: 6205596) whose registered office is at 22 Friars Street, Sudbury, Suffolk, CO10 2AA Natural Stone Solutions is registered for VAT no. 907 5786 88 "Buyer and you" is you the customer. "Goods" means the goods, which the seller agrees to provide to the buyer on these terms. "Delivery Address" is the address at which the seller agrees to deliver the Goods. "Delivery Date" is to be agreed between the buyer and the seller's delivery agent. "Total Price" is the price for the Goods and delivery, inclusive of VAT. The Buyers telephone number will be given to the delivery company, should they need to contact the buyer regarding delivery 2. Basis of the Sale The buyer orders and agrees to buy, and the seller agree to sell, the goods at the total price, subject to these terms and conditions. These terms are the only terms and conditions governing the Agreement. There cannot be a variation or change to anything in this Agreement unless it is agreed in writing and signed by the buyer and seller. This Agreement replaces and supersedes any prior written or oral agreements, representations or understandings between the buyer and seller in respect of the Goods. The buyer confirms that you are not entering into this Agreement on the basis of, or relying on, any representation made to the buyer by the seller that is not expressly incorporated into this Agreement in writing and signed by both of us. In particular nothing said by any of our staff or representatives about the nature or quality or suitability of the Goods is part of or varies this Agreement. The Seller does not give any warranty as to the suitability of the Goods for any given environment. You cannot rely on any implied or express representation, advice or information given to you by us, that is not incorporated into the Agreement. The Seller cannot accept liability for any typographical error or omission in any print or web document, and shall be subject to correction without any liability on the part of the seller. The Seller cannot be held responsible for circumstances beyond their reasonable control. This may include (without limitation) shortfalls at source, natural disasters and restraints or delays affecting suppliers or transportation to the seller. 3. Orders and Specification It is the buyer's responsibility to check that all the details relating to the order is correct. It is important that the buyer checks the measurements carefully. An order should always include an additional 10% to allow for wastage to cover cutting, minor imperfections and breakage. If enough goods are not ordered any subsequent goods may not be exactly the same as the original goods due to the goods being a natural product. It is the buyer's responsibility to ensure that they have ordered the correct quantity of Goods and we will not be responsible for any shortfalls or surpluses. Delivery for basins will usually be made by a courier service. A signature will be required for on delivery of the item(s). Notification will be sent by e-mail to the buyer confirming the date of delivery. Customers who require delivery to the Scottish Isles, Channel Isles, Isle of Man, Isle of Wight, Northern Ireland and Republic of Ireland must contact the seller to confirm exact delivery costs. the seller cannot process any orders to these areas until a personal delivery quote has been given 4. Quality and Description All descriptions, pictures specifications, advertising and samples of our Goods contained on the sellers website, catalogues or brochures are for the purpose of giving an approximate representation of the Goods only. They do not form part of the agreement. The Buyer acknowledges and accepts that the Goods are made from a natural resource and variations in colour, shading, markings, texture, and size between consignments, will occur. 5. Price and Payment The cost of goods is exclusive of any value added tax, which the Buyer must pay in addition. The Seller reserves the right to change the Price by giving the Buyer notice at any time before delivery to reflect any increase in the cost to the seller such as foreign exchange fluctuations, alteration of duties, increase of the costs of materials and such like. Payment is required on placement of the Buyers order. Please note that the seller will not arrange delivery until funds have been cleared. 6. Delivery & Returns Once an order has been placed and payment cleared depending on the goods ordered delivery is usually within 7 working days, providing the material is in stock. On pallet orders the Seller will contact the Buyer to agree a date for delivery, however, delivery times cannot be guaranteed. All pallet orders will be delivered on a large lorry with a tail lift and pump truck so it is important that any restricted access details and non hard standing surfaces (ie. gravel drives) are advised prior to delivery. The load will be placed, at the driver's discretion, to the nearest safest point to the property; this may be on the drive or pavement. The delivery driver cannot help handle the goods, so please arrange for somebody to help or oversee the offload. Delivery for basins will usually be made by a courier service. A signature will be required for on delivery of the item(s). Notification will be sent by e-mail to the buyer confirming the date of delivery. Most nationwide deliveries are between the hours of 9.00 am and 5.00 pm, Monday to Friday. For all deliveries the Buyer needs to ensure that a responsible person will be available on the site to inspect the goods and sign the delivery note. All orders must be examined on delivery and any damages/shortages must be noted on the delivery note and handed back to the driver. Damaged goods will then be replaced as a soon as possible and are subject to stock availability. Any damages not notified at the time of delivery must be reported to us within 48 hours. Photographic evidence and a description of events at delivery must be submitted in order for us to evaluate any claim. If the goods are not delivered on the agreed date as a result of you not complying with your obligations under these terms, the driver will retain the goods and you will be responsible for any re-delivery or storage charges. Customers who require delivery to the Scottish Isles, Channel Isles, Isle of Man, Isle of Wight, Northern Ireland and Republic of Ireland must contact the seller to confirm exact delivery costs. Acceptance and Liability If an incorrect amount of the Goods is delivered and you notify us within the 7 days, we will arrange to deliver or make available the correct quantity of the Goods. You will be deemed (assumed) to have accepted the Goods if you have not returned them to us or informed of us of their rejection within the 7 days, or if you have installed them. We take care to ensure that all of our Goods leave in perfect condition. If there is any obvious damage to the Goods, please make a note of the damage on the delivery note, as this will enable us to make a claim against our carrier. If you tell us about any shortfall or damage in the Goods within the 7 days after delivery our only obligation to you will be to make good any shortage or to replace any damaged Goods. For the avoidance of doubt, we will in no event be liable to you unless you are able to demonstrate to our reasonable satisfaction that there was a shortfall or damage in the Goods. 8. Right of Cancellation (Distance Selling) You may cancel this Agreement within 7 working days beginning the day after you receive the Goods. If the goods have been received damaged, you must inform us at the time of receipt of the goods or within 48 hours of the goods being received and signed for (see section 6 Delivery and Returns). You cannot cancel if the Goods are made specifically for you, or you have installed or laid them or used them. If you wish to return the Goods then you must send them to us. You must pay for the cost of sending the Goods back to us. To cancel you must let us know in writing that you wish to cancel. You may do this by letter or email sent within the 7 days. The cost of the goods will be refunded minus any delivery and collection costs that we have incurred. You should allow up to 30 days from the date of cancellation for any refund. It is your responsibility to take care of the goods until they have been collected. |
